Welcome to KEZZARI ("KEZZARI," "we," "us," or "our"). These Terms of Service govern your access to and use of the KEZZARI website, mobile applications, and related services (collectively, the "Services").

By accessing the website, registering an account, or purchasing our premium perfumes, you agree to be bound by these terms, as well as all applicable laws and regulations in India. If you do not agree with any of these terms, you are prohibited from using or accessing our website and services.

1. User Account Registration & Login

To access certain features of our platform, including orders, wishlists, and purchase histories, you may register an account.

• Verification: Registration and subsequent login utilize your email address or integrated social logins (e.g. Google). You may authenticate using a secure password, a One-Time Password (OTP), or a passwordless verification link.
• Account Responsibility: You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your verified account.
• Accuracy & Address Management: You agree to provide accurate, current, and complete information during registration. You may save and categorize multiple delivery addresses (e.g. Home, Office) in your profile. You are strictly responsible for maintaining the accuracy of your active delivery addresses, including precise PIN codes and contact numbers, to prevent delivery failures and Return to Origin (RTO) penalties.
• Account Status & Profiling: We maintain internal profiles based on your order history, total spend, and return frequency. We reserve the right to classify, limit, or suspend accounts exhibiting suspicious activity, excessive cancellations, or frequent Returns to Origin (RTO).
• Communications: By registering, you consent to receive transactional notifications, marketing updates, and automated behavioral reminders (such as abandoned cart emails) via your registered contact details. You may opt out of promotional communications at any time.

2. Product Orders & Pricing

All products listed on the kezzari.com are subject to availability.

• Pricing: All prices are displayed and transactions are conducted in Indian Rupees (INR). Prices are inclusive of applicable GST (Goods and Services Tax) in India unless stated otherwise.
• Acceptance: We reserve the right to refuse or cancel any order at our sole discretion, including cases of product unavailability, inaccurate pricing descriptions, or suspected fraudulent activity.
• Cancellations: Please refer to our Shipping and Returns policy for details on cancellations. Once an order has been processed and shipped, it cannot be canceled.
• Refunds & Return to Origin (RTO): For prepaid orders that are returned to our origin warehouse by the shipping carrier (typically due to an unlocatable address, customer unavailability, or rejection at delivery), a designated RTO processing charge may be deducted from the total refund value to cover logistics penalties. The remaining balance will be refunded to the original payment method.

3. Secure Payments via Razorpay

We provide secure, integrated online transaction capabilities for a seamless shopping experience.

• Processor: All payments are securely routed and processed through our RBI-compliant payment gateway partner, Razorpay.
• Supported Methods: We support payments via Credit/Debit Cards, UPI, Netbanking, and major digital wallets.
• Security: All transaction details are encrypted using industry-standard SSL protocols. KEZZARI does not collect or store your card numbers, CVVs, or payment PINs.

4. Promotional Reward Balances & Discounts Policy

KEZZARI may from time to time credit your verified customer profile account with a promotional rewards balance or store credit (collectively, "Reward Balance") under marketing campaigns, goodwill credits, or support resolutions, as well as offer promotional discount codes.

• Discount Codes: Promotional discount codes may be subject to specific restrictions such as minimum order values, usage limits, or expiration dates. Additionally, certain discounts may be personalized and restricted to first-time buyers, specific genders, or individually selected customer profiles. Discount codes are generally limited to one per order and cannot be combined with other ongoing sales or reward balances unless explicitly stated.
• In-Store Shopping Use Only: Reward Balances are strictly promotional store credits that can be applied to subtract from transaction invoice subtotals during checkout on the KEZZARI website.
• No Monetary Currency Value: Reward Balances and Discounts have zero actual monetary value outside the website. Under no circumstances can they be redeemed, withdrawn, cash-backed, returned, or converted into physical currency, cash, or credit to bank accounts, debit/credit cards, UPI IDs, or external digital wallets.
• Non-Transferable: Reward Balances are exclusive to your verified account. They cannot be transferred, sold, gifted, or assigned to other customer accounts or third-party profiles.
• Administrative Rights: KEZZARI reserves the absolute right to audit, correct, adjust, or revert any sent Reward Balance or invalidate any discount code. Common reasons for reward reversal include order cancellations, product returns, administrative errors, double grants, expiration of promotional periods, or suspicious and fraudulent activities.

5. Refer & Earn Program

Our Refer & Earn program rewards both existing customers (Referrers) and new customers (Recipients) for growing the KEZZARI community.

• Recipient Welcome Bonus: When a new user successfully registers an account for the first time using a valid referral link, they will instantly receive a fixed Welcome Bonus credited to their Reward Balance.
• Referrer Reward: The Referrer will only receive their referral reward balance after the referred new user successfully completes their very first purchase on the platform.
• Eligibility & Fraud Prevention: Referral rewards are strictly for introducing genuine new customers. Self-referrals, the creation of multiple accounts by the same individual, or any attempt to manipulate the referral system will result in immediate suspension of the associated accounts and complete reversal of all fraudulently acquired reward balances.
• Link Expiration & Feature Availability: To ensure the integrity of the program, all newly generated referral links automatically expire 30 days from the date of generation. Additionally, KEZZARI reserves the right to pause, modify, or permanently discontinue the Refer & Earn feature at any time without prior notice. Existing, unexpired links will be honored until their respective expiration dates.

6. Shipping, Delivery & Custom Duties

We ship our products across India.

• Timeline: Dispatch timelines and delivery estimates are provided as general guidelines. Estimated delivery dates are estimates only and do not constitute a guarantee. Delivery delays due to public holidays, adverse weather, or courier constraints are beyond our control.
• Risk of Loss: The risk of loss and title for items purchased from KEZZARI pass to you upon the successful delivery of the items to your specified address.

7. Intellectual Property Rights

All content on the KEZZARI website—including text, graphics, logos, images, digital media, product names, brand aesthetics, and code—is the exclusive property of KEZZARI and is protected by trademark, copyright, and other proprietary laws of India and international treaties.

You may not reproduce, distribute, modify, display, perform, or use any brand assets without express prior written consent from our management.

8. User Conduct & Restrictions

You agree not to use our Services to:

• Conduct any fraudulent activity or impersonate any person or entity.
• Engage in any deceptive, manipulative, or abusive practices, including manipulating reviews, ratings, or promotional systems.
• Interfere with or disrupt the operation of the website, servers, or networks hosting our Services.
• Utilize automated scripts, spiders, or scrapers to extract data from our online catalog.
• Attempt to gain unauthorized access to our databases or customer records.

9. Limitation of Liability

To the maximum extent permitted under applicable law, in no event shall KEZZARI, its directors, officers, or employees, be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, products, or website, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these terms shall not exceed the amount paid by you for the specific product purchase in question.

10. Force Majeure

KEZZARI shall not be liable for delays or failure caused by events beyond our reasonable control including natural disasters, government actions, strikes, internet outages, pandemics, or courier disruptions.

11. Account Suspension & Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without prior notice, if you violate these Terms of Service, engage in fraudulent activity, or for any other conduct that we deem harmful to our business, our users, or third parties.

12. Governing Law & Jurisdiction

These Terms of Service, along with your use of the website and any transactions completed, shall be governed by and construed in accordance with the laws of India.

Any legal action, dispute, or proceeding arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts located in the State of Gujarat, India.
